ALTICARTA TERMS OF USE & LICENSE AGREEMENT

Effective Date: 2026-08-27

These Terms of Use and License Agreement ("Terms") govern your use of the Alticarta service, located at alticarta.com ("the Service"), and any digital files generated, downloaded, or otherwise obtained through the Service ("Files").

The Service is operated by Alticarta ("we," "us," or "our"), a sole proprietorship registered in the Province of Ontario, Canada.

By accessing the Service, creating an account, or downloading any File, you ("you" or "the User") agree to be bound by these Terms in full. If you do not agree to these Terms, you must not use the Service or download any File.


1. THE SERVICE

Alticarta provides a web-based service that generates three-dimensional digital model files representing topographical features of geographic regions, including but not limited to countries, provinces, states, regions, mountains, and geological features. Files are made available for download in formats including STL, OBJ, and 3MF.

The Service operates on a tiered access model:

Pricing and inclusions for each tier are published on the Service and may be updated from time to time. Existing subscribers will not have their subscription terms changed mid-cycle without notice.


2. LICENSE GRANT

2.1 Free Tier License

Files downloaded under the Free Tier are licensed for personal, non-commercial use only. This license permits you to:

(a) Download Files to your personal devices;

(b) 3D print, CNC machine, or otherwise physically fabricate Files for your own personal use, including for display in your home, as personal gifts to friends or family members, or for personal hobby use;

(c) Modify Files for your own personal use, provided that any modifications remain subject to these Terms.

Free Tier Files may not be used to fabricate physical objects for sale or any other commercial purpose.

2.2 Paid Tier License (Per-Download and Subscription)

Subject to your compliance with these Terms and payment of any applicable fees, Alticarta grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

(a) Download Files to your personal devices;

(b) 3D print, CNC machine, or otherwise physically fabricate Files for personal use;

(c) Fabricate and sell physical objects produced from a File, up to a maximum of one hundred (100) physical units per individual File, in total, across all sales channels and over the lifetime of your access to that File ("Standard Commercial Fabrication Allowance");

(d) Modify Files for your own fabrication purposes, provided that any modifications remain subject to these Terms and are not redistributed in digital form.

For the purposes of this section, each generated download is a distinct "File." Files generated with different parameters (such as different regions, base thicknesses, output modes, or detail levels) are each treated as separate Files with their own separate Standard Commercial Fabrication Allowance.

2.3 Common Restrictions (All Tiers)

Regardless of tier, this license does not permit you to:

(a) Sell, resell, lease, rent, sublicense, or otherwise distribute the digital File itself, in whole or in part, in its original or any modified form;

(b) Fabricate and sell more than one hundred (100) physical units per File without obtaining an Extended Commercial License under Section 2.4;

(c) Upload, share, or distribute Files to any public repository, marketplace, file-sharing service, or third-party platform;

(d) Use Files, or any data derived from Files, to train, fine-tune, or develop any machine learning model, artificial intelligence system, or automated generation tool;

(e) Reverse engineer, decompile, or attempt to extract the underlying generation methods, data sources, or algorithms used by the Service;

(f) Use any automated, scripted, or programmatic means to access the Service, generate Files, or perform bulk downloads, except for ordinary use of a standard web browser;

(g) Remove, alter, obscure, or attempt to defeat any watermark, identifier, signature, or other identifying feature embedded in Files.

2.4 Extended Commercial License

If you anticipate fabricating and selling more than one hundred (100) physical units of any individual File, you must contact Alticarta in advance to discuss an Extended Commercial License. Extended Commercial Licenses are considered on a case-by-case basis and priced individually based on intended use, volume, and channel. Alticarta is under no obligation to grant an Extended Commercial License.

Continued sales beyond the Standard Commercial Fabrication Allowance without an Extended Commercial License constitute a material breach of these Terms.

2.5 Record-Keeping

Where requested by Alticarta in connection with a suspected breach of the Standard Commercial Fabrication Allowance, you agree to provide reasonable evidence of your physical unit sales for the relevant File or Files, including but not limited to sales records, platform reports, or invoices. This provision survives termination of your account.


3. WATERMARKING AND TRACEABILITY

Files generated by the Service are individually identifiable through robust digital watermarking techniques applied at the time of generation. These techniques are designed to survive format conversion, modification, and re-export.

By downloading any File, you acknowledge and agree that:

(a) Each File is uniquely associated with the account that generated it;

(b) Alticarta may use watermark data to investigate suspected violations of these Terms;

(c) Files found in unauthorized distribution can be traced to the originating account;

(d) Attempts to remove or defeat watermarking constitute a material breach of these Terms.


4. ACCOUNTS AND BILLING

To access paid tiers of the Service, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Subscription fees are billed in advance on a recurring basis every thirty (30) days, on the anniversary of your sign-up date. You authorize us to charge your payment method for the applicable fees and any taxes. You may cancel your subscription at any time; cancellation takes effect at the end of the current paid billing cycle, and you retain access to your tier's downloads for the remainder of that cycle.

Each subscription tier grants a fixed number of fine-detail file downloads per thirty (30) day billing cycle, according to your tier as published on the Service. Your download allowance resets at the start of each billing cycle. Unused downloads do not roll over and are not carried forward; any portion of your monthly allowance not used within a billing cycle is forfeited at the end of that cycle.

Continued access to paid-tier downloads depends on successful payment. If a recurring payment fails or is declined, paid-tier access (including the download allowance) ends, and your account reverts to Free Tier access until payment is successfully resumed. You retain access only for billing cycles that have been paid in full.

Subscriptions are intended for individual personal use within the licensing scope set out in Section 2. We may contact account holders whose usage patterns appear inconsistent with normal individual use — for example, unusually high download volumes, automated or scripted access, or apparent account sharing across multiple users — to discuss the situation. Where issues cannot be resolved through good-faith communication, we may suspend the account.


5. REFUNDS

All sales are final. Due to the nature of digital downloads, we do not offer refunds for delivered Files or for completed subscription billing cycles.

If you experience a technical issue with a downloaded File — including file corruption, failed generation, or a substantial mismatch between the File and the parameters you selected — you may contact us at digitalmakerca@gmail.com within seven (7) days of the relevant download. Where the issue is verified, we will provide a corrected File at no additional charge. This is offered as a goodwill remedy and does not affect the "all sales final" policy stated above.


6. INTELLECTUAL PROPERTY

The Service, including its software, design, content, branding, and underlying generation pipeline, is the exclusive property of Alticarta and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

Files generated by the Service incorporate elevation data licensed from third-party providers. Your license to use Files is governed by these Terms, which are at least as restrictive as the underlying data licenses. Nothing in these Terms grants you any rights to the underlying elevation data, generation algorithms, or service infrastructure beyond the limited file-use license granted in Section 2.

The Alticarta name, logo, and branding are trademarks of Alticarta. You may not use them without our prior written consent.


7. PROHIBITED CONDUCT

In addition to the license restrictions in Section 2, you agree not to:

(a) Use the Service in any manner that violates any applicable law or regulation;

(b) Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its infrastructure;

(c) Impersonate any person or entity or misrepresent your affiliation with any person or entity;

(d) Use the Service to generate Files representing geographic regions in a manner that is defamatory, harassing, or intended to cause harm.


8. ENFORCEMENT

Alticarta actively monitors third-party platforms — including but not limited to Etsy, Cults3D, MyMiniFactory, Thingiverse, eBay, Amazon, and similar marketplaces — for unauthorized listings of Files or evidence of physical unit sales exceeding the Standard Commercial Fabrication Allowance.

Where unauthorized use is identified, we may, at our sole discretion:

(a) Issue takedown notices under applicable copyright legislation, including the Digital Millennium Copyright Act (United States), the Copyright Act (Canada), and equivalent legislation in other jurisdictions;

(b) Suspend or terminate the originating account without refund;

(c) Pursue any other remedies available at law or in equity, including but not limited to claims for breach of contract.

You agree that the watermark identification embedded in Files constitutes evidence of the originating account for purposes of any such enforcement action.


9. TERMINATION

We may suspend or terminate your account and access to the Service at any time, with or without notice, for any material breach of these Terms. Upon termination:

(a) Your license to use any Files previously downloaded remains subject to these Terms, including all restrictions in Section 2;

(b) Any unused portion of your current billing cycle's download allowance is forfeited;

(c) No refund will be provided for the current or any prior billing cycle.

You may terminate your account at any time by cancelling your subscription and contacting us to request account closure.


10. DISCLAIMERS

THE SERVICE AND ALL FILES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

We do not warrant that:

(a) Files will accurately represent any particular geographic feature for any specific purpose, including navigation, surveying, engineering, or scientific use;

(b) The Service will be uninterrupted, error-free, or available at any particular time;

(c) Any errors or defects will be corrected.

Files are intended for decorative, hobbyist, educational, and limited commercial fabrication purposes only. They are not suitable for navigation, engineering, surveying, scientific measurement, or any application where accuracy of geographic representation is critical to safety or function.


11. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Alticarta's total aggregate liability to you for any and all claims arising out of or related to the Service or these Terms shall not exceed the greater of (a) the amount you paid to Alticarta in the twelve (12) months preceding the claim, or (b) one hundred Canadian dollars (CAD $100).

In no event shall Alticarta be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, business interruption, or damage to physical property arising from the use of Files (such as 3D printer malfunction or CNC machine error), regardless of the legal theory under which such damages are sought.

Nothing in these Terms limits any liability that cannot be limited under applicable law, including under the Consumer Protection Act, 2002 (Ontario) or equivalent consumer protection legislation in your jurisdiction.


12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Alticarta from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

(a) Your breach of these Terms;

(b) Your use of the Service or any File outside the scope of the license granted;

(c) Your violation of any applicable law or the rights of any third party.


13. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

Any dispute arising out of or related to these Terms shall be resolved exclusively in the courts of the Province of Ontario, and you consent to the personal jurisdiction of those courts. This provision does not prevent us from seeking injunctive or equitable relief in any jurisdiction where unauthorized use of Files is occurring.


14. CHANGES TO THESE TERMS

We may update these Terms from time to time. Material changes will be posted on the Service with an updated effective date. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to updated Terms, you must stop using the Service and may cancel your account.

Files downloaded under prior versions of these Terms remain governed by the version in effect at the time of download.

16. ENTIRE AGREEMENT

These Terms, together with any other agreements expressly incorporated by reference, constitute the entire agreement between you and Alticarta regarding the Service and supersede any prior agreements or understandings. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
